1 Agreement to Terms

By downloading, installing, or using Genesis AI, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our AI-powered image and audio processing services.

Genesis AI is a mobile application that provides AI-powered image processing using Flux Kontext Pro and audio processing using RVC (Retrieval-based Voice Conversion) technology via our secure Google Cloud backend infrastructure.

2 Service Description

Genesis AI provides the following AI-powered services:

• Image Processing: AI-powered image transformations, enhancements, and style transfers using Flux Kontext Pro
• Audio Processing: Voice conversion, audio enhancement, and sound modification using RVC technology
• Cloud Processing: Secure, high-performance processing via Google Cloud infrastructure
• Mobile Application: User-friendly interface for uploading, processing, and downloading media

3 User Accounts & Subscriptions

Account Registration: You may be required to create an account to access certain features. You are responsible for maintaining the security of your account credentials.

Subscription Plans: Genesis AI offers various subscription tiers with different processing limits and features:

• Starter Plan: Limited monthly processing credits
• Pro Plan: Enhanced processing limits and priority processing
• Subscription management handled securely through RevenueCat

Billing: Subscriptions are billed monthly through your device's app store. You can cancel anytime through your app store account settings.

4 Content & Media Guidelines

By using our AI processing services, you represent and warrant that:

• You own or have the right to use all media files you upload
• Your content does not infringe on any third-party rights
• Your content does not contain illegal, harmful, or offensive material
• You will not use our AI tools to create deepfakes or misleading content
• You will not attempt to process copyrighted material without permission

5 AI Processing & Intellectual Property

Processing Rights: By uploading content, you grant us a temporary license to process your media using our AI systems solely for the purpose of delivering your requested results.

Output Ownership: You retain full ownership of processed outputs generated from your content. However, you acknowledge that:

• AI-generated outputs may not be eligible for copyright protection in all jurisdictions
• Similar outputs may be generated for other users with similar inputs
• We do not guarantee uniqueness of AI-generated content

Technology Rights: Genesis AI, Flux Kontext Pro, RVC technology, and our processing algorithms remain our intellectual property or that of our technology partners.

6 Prohibited Uses

You may not use Genesis AI for:

• Creating deepfakes or misleading synthetic media
• Processing content that violates laws or regulations
• Creating content that infringes on others' rights
• Generating harmful, offensive, or illegal content
• Reverse engineering or attempting to extract our AI models
• Automated or bulk processing beyond your subscription limits
• Sharing or reselling our AI processing services
• Creating content that could be used for harassment or impersonation

7 Data Processing & Privacy

Temporary Processing: Your media files are processed temporarily in memory and immediately deleted after processing completion. We do not store your content on our servers.

Privacy Protection: Our data handling practices are detailed in our Privacy Policy. We are committed to protecting your privacy and ensuring your data remains secure.

AI Analysis: Our AI systems analyze your content solely for processing purposes and do not use your data for training or other purposes.

8 Service Limitations & Disclaimers

Processing Limits: Each subscription tier has specific processing limits. Exceeding these limits may result in service restrictions or additional charges.

Quality Disclaimer: While we strive for high-quality results, AI processing outcomes may vary based on input quality, content complexity, and other factors.

No Warranties: Genesis AI is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service or specific processing outcomes.

9 Termination

Your Rights: You may terminate your account and stop using our services at any time by uninstalling the app and canceling your subscription.

Our Rights: We may suspend or terminate your access to Genesis AI if you violate these terms, engage in prohibited uses, or for any other reason at our discretion.

Effect of Termination: Upon termination, your access to our services will cease, and any unprocessed content will be deleted.

10 Limitation of Liability

To the maximum extent permitted by law, Genesis AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability to you for all claims related to Genesis AI shall not exceed the amount you paid for our services in the 12 months preceding the claim.

11 Updates & Changes

Service Updates: We may update, modify, or discontinue features of Genesis AI at any time. We will notify you of significant changes through the app or other means.

Terms Updates: These terms may be updated periodically. Continued use of our services after changes constitutes acceptance of the new terms.

AI Technology: Our AI models and processing capabilities may be updated or improved over time to provide better results.

12 Governing Law & Disputes

These terms are governed by the laws of the jurisdiction where Genesis AI is incorporated. Any disputes shall be resolved through binding arbitration rather than court proceedings.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits.
